The difference John is, that if the speeding statute defined an automobile as being a red object, then it wouldn't much matter that you know that the blue object is an automobile, the statute wouldn't apply to blue cars and you can bring in 1000 experts it won't change that fact.

I once wrote brief explaining for the purposes of a specific statute that a car was not a motor vehicle.
