Some good points. I would also add that in relation to Disney, Coke or some other tradmarks and copyrighted artwork, the corporation also has to protect their image and holsomeness of their product or corporate image. They have to be vigilant about use without authorization because while you might use Mickey Mouse in a reasonable depiction in keeping with the cheracter of the mouse the next guy might try to dress him in a provocotive outfit or put him in a compromising situation thus deminishing the family image. The use of, was it a Muppet(?), in an Osama Bin Laden poster is an example of how an image trademark or cheracter can be corrupted.
