Just a personal opinion that may or may not be correct; but I think that a reference publication is looked upon differently than marketing of a specific item in which a single artwork has been "pirated".

The reference shelves in Libraries and Barnes and Noble book stores would be barren if everything ever produced had to be gotten permission to be reproduced. However the catalog itself may be copywritten for the system that was created by the author in identifying each individual item.
