I don't know about your hypothetical example being a matter of "ethics", but more of a matter of common courtesy. Most chippers who have posted on this subject in the past have indicated they would in all probability grant permission to use their scans, if they were extended the simple courtesy of seeking permission first. To do otherwise, I too would agree with Larry.
