Depends on the statute, Archie. Which is all the point I was trying to make. Conduct is not criminal unless made so by statute. I am not aware of any local N.Y. statute that would make it criminal for two persons to make such agreement but would have to do some research to see if the auctioneers have been able to induce the legislature to enact something.
