I'm not sure I understand your distinction

It seems to me that anything that is copied with the intent to pass it off as the original is a counterfeit. A counterfeit painting does not have to be used to fool the original purchaser who commissioned the painting, or even the current owner of the original. Ok, it's a weak analogy, but I hope you get my point. Intent to defraud is intent to defraud.
