Re: Online poker actually illegal in the US --

Are you aware of any examples of Nevada enforcing that statute? I am not.

The relevant portion of the statute is:

NRS 465.093 Placing, sending, transmitting or relaying wagers to another person prohibited under certain circumstances; penalty.

1. Except as otherwise provided in NRS 465.094, a person, alone or with others, shall not knowingly:

(a) From within this state, place, send, transmit or relay through a medium of communication a wager to another person or an establishment that is located within or outside of this state;

I would highly doubt that there have been prosecutions of individuals playing online poker or casino games for multiple reasons, most notably the difficulty in finding violators and proving the violation. this is why the Washington State ban will make zero difference.

It would be my guess that the statute has been enforced but more often in connection with illegal gambling operations operating within the state. It would very likely be an additional charge when an illegal bookmaker is caught and they find that he was laying off bets with an offshore operation.

The only effective way to substantially curtail internet gambling in the U.S. would be to effectively prevent easy money transfers to and from U.S. financial institutions.
