It is not my opinion. This is not a question of terms. This is a question of when title passes (ownership changes). The seller bears the risk of loss until title changes hands (buyer takes actual delivery).

Bidding on an auction will not pass title regardless of what the item description says. Disclaimers such as "I will not be responsible" aren't worth the time it took to type them since you can't pass title with a disclaimer.
