Its interesting that before I even read this thread I had a similar conversation with my roommate. He is an assistant DA and was #####ing about some local attorney who is trying to use him as a collection agency.

I don't know any details about the incident here, but the way investigators and prosecutors view these things is that without a significant pattern it is hard to distinguish theft from a civil dispute. That is why it is hard to to get prosecution of isolated cases of a sale gone bad.

I'm not saying they shouldn't pursue this case, I'm just trying to give you some idea of how they think.
