eBay's Feedback System Sucks!!

We recently had a guy leave a negative FB months after the auction ended. His feedback claimed that the (.99 cent) item was misrepresented and poorly packed. Problem was... We never sent the item to him!! He was a deadbeat.. We left negative feedback on him.... got a credit back from eBay for the fees... relisted the item... then sold and shipped it to the "new" high bidder... who then left positive feedback.

I complained to eBay... Sent them both auctions numbers showing that I had relisted the item and sold it to the second guy and that the first guy lied and left false feedback.

Section #8 of their User Agreement says...
""""You may not take any actions that may undermine the integrity of the
feedback system. """""

I reminded them about THEIR rules and....

eBay replied that they would not remove his retalitory negative feedback because of "Freedom of Speech"!!!

eBay is very aware of some of the problems inherent in the current
feedback forum. Rest assured we do investigate our members concerns over
a specific piece of feedback. However, there is nothing we can do if a
member has left vindictive and retaliatory feedback. Each member of eBay
has the opportunity to comment on a particular transaction in any way
they see fit. With this in mind we have set up the feedback system so
that a member's rating can only be increased or decreased by one point
through the efforts of another member. Please keep in mind a community
the size of eBay is bound to attract a few bad apples. These individuals
have the same rights as any other member of the community to express
their feelings over a transaction. We cannot exclude a few individual
from leaving feedback based on their retaliatory feedback. I am by no
means attempting to justify vindictive feedback such as that which you
have received, but simply clarifying the purpose of feedback on the
site.

If you have any future questions or concerns regarding any aspect of
eBay, please do not hesitate to contact us.

Sure seems to me that this person took an action that undermined the
integrity of the feedback system. I gave you both of my auction numbers
and
proved to you that I never sold the item to him... but rather to the
high
bidder on the 2nd auction.

His negative feedback to me clearly says that he received the item...
poor
condition, etc... An obvious lie and false feedback entry.

Why won't you do something?

Unfortunately, eBay does not edit, alter or delete any user-supplied
data in any public area of eBay except at the direction of our Legal
Department. Altering data only occurs in extreme circumstances, for
example if the User Agreement is violated. Retaliatory feedback is not a
User Agreement violation.

However, what you done is correct. Responding to the feedback that was
left in your profile, explaining your view of the situation. This way,
anyone looking at your feedback will see a balance of information on the
situation. Please remember that most members will ignore this incident
and recognize the general pattern of "positive" transactions that you
have achieved.

I'm sorry that we couldn't be of more assistance at this time. If you
have any other questions or problems, please don't hesitate to contact

Please investigate the following...

Regarding eBay item #190214496

I listed this item on 11-7-99. After three emails (the last on 11-28)
to
the winning bidder he still had not sent the funds. I requested a credit
of
fees from eBay and left negative feedback for the bidder.

Yesterday (1-24, almost 2 MONTHS after I applied for credit with eBay
and
left negative feedback on this dead beat bidder) while checking my
feedback
comments, I discovered that the bidder had left negative feedback
against me
and the comment is completely false and makes no sense! He says the
items
was shipped late, poorly packed and not as described. I never sent the
items to him because he never paid!!!

IMPOSSIBLE!!!

The item was actually RELISTED as item #213636773 on 12-13 and shipped
to
the high bidder (a Larry Carr) on 12-22.

This feedback left by Jamie Wheeler certainly seems to fall into your
category of false and retaliatory feedback!! Will you please
investigate
this and remove this false and malicious comment from my feedback
listings?

Please get back to me on the action taken regarding this bidder and his
false comments.
