I don't know diddly-squat about the issues, but as a former General Counsel for two publicly traded companies, I concur with the comment that litigation is not a path to embark on for your organization. Kinda like taking a long walk down a short bridge with predictable "no win"results.

What's wrong with you folks?

Your hobby/biz is on steep decline and you engage in nonsensical internal bickering. Sounds like a recipe for failure.

It may be too late to salvage this sinking ship, but you folks seemingly are on a fast track to oblivion. Reminds me of the 60's hit song lyrics "We're on the eve of destruction!"
