"The fact of the matter is that "we the people" are the government. These laws would not be passed if the majority of the people (ie "customers") were not saying enought is enought. We should not be subject to someone sitting beside us and fouling up the air we are breathing! The ratio is getting bigger and bigger as to non-smokers vs smokers. What it boils down to even if a hundred years from now they prove second hand smoke won't kill anyone it still makes a non-smoker uncomfortable. What a smoker is saying when he talks about "rights" is that he don't give a $hit what you think or how bad it stinks and if the dealers don't like it they can go work somewhere else!"

You pretty much made my point James. Government-sanctioned discrimination is okay as long as you are not in the targeted minority group.

I find a lot of odors associated with human beings to be offensive to my olfactory senses. Given that I spend a lot of time on airplanes, I've run into some that are intentionally placed in my presence that have cause allergic reactions, i.e., I've been around perfumes that caused my eyes to water, and shortness of breath and coughing on my part. Perhaps we should outlaw perfumes, colognes, deodorants and other such smelly products except in private homes because someone will find them irritable or offensive. Then there's body odors and flatulence. What would you propose to do about them?

As to private property rights. It doesn't matter if an individual or a corporation owns a property. If it isn't government owned, the government should have no right to tell the owner(s) what legal activities can take place on their private property, and that includes properties that require licensing for adult only activities (like gaming and alcohol consumption). If not allowing smoking BY THE CHOICE OF THE OWNER(S) of said private property results in higher revenue and profits, many other similar businesses would follow suit ON THEIR OWN!

Make the products illegal, quit taxing them at a higher rate than any other other consumer product, or quit discriminating against those who buy and use legal products. .....there are some places in this country where suit has been brought against people for smoking in their own homes because neighbors could smell it. ....there are communities in this country that have proposed no smoking laws within private residences. ....it is illegal within the city limits of Boulder Colorado to smoke in your own car with a window rolled down.

Make the product illegal and all those annoyed by its use will be happy. That won't happen because the government can't afford the lost tax revenues.
