No, the problem is ...

... that the seller is intentionally misrepresenting the scarcity of this chip and is hoping to lure a buyer with no knowledge of that scarcity into bidding on it. There would be no issue if he had a $399.99 buy-it-now but described it correctly. This is not a rare chip, and I'm sure he knows it.
