I didn't see any statements were the deer had been read his rights before being detained. It is quite possible the deer had traveled from Canada and did not understand the English language (as the article stated a "wandering deer") and feared for its life when the officer pulled his weapon. Being unarmed and defenseless, the deer ran causing the officer to believe the deer was eluding arrest, therefore the officer used lethal force. The actions of the police officer come into question because up until the arrest the deer had committed no crime. The deer was simply trying to find a good room with a nice salad bar for the night when he was confronted by the officer demanding his passport or other identification. Witnesses heard the officer make sexual comments of "What a rack!" before approaching the deer.

No doubt the deer is being held in a small 'holding cell' that is acclimatized for the deer's natural winter habitat (a freezer) where he awaits sentencing along with two other jailbirds (a turkey and a chicken). It is unlikely the deer will make bail because he says he has no 'doe'.
