NCR, Interesting Question....

A friend and I were talking and came up with an odd question. I DO NOT KNOW THE ANSWER. What’s your opinion/thoughts?

A key witness to an event who really does not want to appear in court is forced to appear by a court that commands his presence testify under a subpoena.

The witness steps up on the stand and raises his hand and is asked “Do you swear to tell the truth so help you God?” (or words to the effect).

He replies, “No.”

What recourse does the court have to compel the witness to testify?

Can he be charged with contempt of court by answering the question (the oath) honestly?

He cannot be charged with perjury if he lies since he clearly stated he did not swear to tell the truth.
