Looks to me like it would probably be considered a legitimate variation.

A rule of thumb I usually use on these color varieties is that if I can take a stack of the chips and fairly easily sort them into stacks of each variation without having several color variations between the two, then I consider it a variety.

Do you have any spares of the darker one?
