Question For the Lawyers in the club

I just got a threating email from a ebay seller that states that my item description (shipping instructions to be exact) are too similiar to theirs, and that I am to cease using this shipping instruction. They go on to say that they have this copyrighted. My question is, can this be right? Does ebay not own what descriptions are placed on their service? Can a simple shipping instruction be copyrighted for use on Ebay, Nothing in the description says anything about being copyrighted. Your help is appreciated, Kevin B. R-5375
