The Court did not hold that the machines were illega; found thme to be of the kind (lotto/bingo - Class II Indian Gaming Act machines) that are valid. What was unconsitutional was that the some of thye moneys from the machines were going to the tracks instead of Education as required by law. I doubt that the decision will stand up on appeal but if it does suspect that the legislature will react. racinos are all that keep the race tracks afloat--shame though, since horse racing is the latest victim of state wide casinos (Indian in New York).
