Regardless of when any patent ...

... may have expired, what David Whalen is doing could not constitute patent infringement anyway. He is not producing and selling a new product which infringes on the patented design. He is repairing (or modifying) a product which was manufactured by or with the consent of the patent holder.

If that constituted patent infringement, all of the independent maintenance/repair people in the world would be out of work.
