Thanks everyone for your help! I just sent an e-mail to the other seller asking him not to use my description and photo. Gave him until the morning to change it; if he hasn't, I told him I'd report it to ebay.

The sad thing is, I'd have let him use my description if he'd asked beforehand. Not the photo though, since that would be mis-representing his item!
