My understanding is that all gaming comes under the jurisdiction of the State. If there is some form of gaming in the state (Bingo, horse racing, etc.), Indian reservations are also entitled to have gaming. I believe there is also U.S. law that comes into effect to regulate if a given tribe is recognized by the gov't in order to be able to have gaming. State law also controls what form of gaming is allowed on the reservation and what compensation the state is entitled to.
