MORE ON THE NY COURT ANTI-TRIBAL CASINO CASE

More on the story of the lower court decision finding the Tribal compacts invalid because not approved by the NY legislature. The suitors claim they do not desire to close the casinos only to gain legislative regulation and control--so that any future growth or change would have to go through that branch of state government. In Oneida (Turning Stone) there is a long history of citizen antagonism against the Oneida casinos exacerbated by a federal court law suit by the tribe (and other tribes) to declare that a substantial amount of Upstate New York land should be returned to the nation or adequate compensation given. Further, the Oneidas, being a Sovereign Nation won't contribute to the Oneida city or county (or state for that matter) treasury. With their substantial income from Turning Stone the Oneidas have been able to buy more and more land around their casino and each time this occurs the land is taken off the tax rolls.
