••• MAIL FRAUD •••

When information is received from a postal
customer concerning possible mail fraud "scheme,"
it's reviewed to determine if a possible violation
has occured. If the United States Postal
Inspection Service (not a part of USPS) questions
the legitimacy of a particular mailing or company,
they may then collect evidence to prove an
intentional "scheme" to defraud. They base their
evidence on a number of factors, including whether
use of the mail is an integral part of the
"scheme," and the "number and 'pattern' of
complaints they receive concerning a particular
mailer." Evidence to support a violation may then
be presented to the appropriate U.S. Attorney for
prosecutorial consideration or forwarded to the
Postal Service Generals Councesl's office for
consideration of administrative action to deprive
the violator of the "receipt of mail."

All information rceived by the USPIS will be
recorded in their Fraud Complaint System, which
enables them to "identify and monitor" persons who
generate consumer complaints.

In the event future evidence is developed to
indicate that mail fraud laws are being violated,
appropriate action will be taken.

What this all boils down to is that if there is
not a "number and pattern of complaints," such
persons will continue to operate and continue to
dupe the USPIS as does one:
