Missing Chip...Ethics Question

I recently was offered and bought a $25 Hard Rock Cure Chip by a well known chip dealer for $200. I sent my usual Postal MO right away. About a week later, a small Bubble Wrap Mailer came in the mail....EMPTY!! There was the word "fragile" (stamped by the seller" where the folding flap would meet the envelope. The flap has a tear from top to bottom, big enough for the chip to escape from, then appears to be resealed.....there was no attempt to rematch the word "fragile".

The envelope is the 6 1/2"X4 3/4" size that does not have to be hand cancelled and the machine COULD have squeezed this chip out and even possible resealed the envelope.

OR....the chip could never have been placed in the envelope at all, and this could have been done over & over at $200 a crack......

I have written several emails to the seller, told him to check with his Postal Lost & Found, given him plenty of time to rectify the situation, but he now refuses to replace the chip or refund the money....

He made a handsome profit selling a $25 Chip for $200 and therfore included shipping, but neglected to insure what he sent.

My question.....Is HE responsible for this....or am I just out the money that I sent? What's YOUR opinion???
